Terms of warranty for QBRICK RED UHD products


TERMS OF WARRANTY FOR QBRICK PRODUCTS GIVEN BY SPECIALIST+ 


1 January 2024


This Warranty applies to all products of QBRICK RED product line that are marked with a designated warranty sticker including items of PRO, PRIME and ONE series purchased on or after 1 January 2024 (inclusively) from supplier RM TOOLS, UAB in its SPECIALIST+ stores in Vilnius, Kaunas or Klaipėda, in online stores www.rmtools.eu and www.rmtools.lt, or at retail/wholesale outlets of the company’s authorised dealer.


This Warranty is complementary to the mandatory warranty given by the Seller or the Seller’s Authorised Dealer.


1. TERMS AND DEFINITIONS


BUYER means a natural person or a legal entity that has purchased, either directly from the Supplier or from the Authorised Dealer, a QBRICK RED product/products supplied /imported by RM TOOLS, UAB.

SELLER means RM TOOLS, UAB, registered company No 300531445, registered office address Kalvarijų g. 143-16, LT-08352 Vilnius

DATE OF PURCHASE means the date of purchase of a QBRICK RED product/products from the Authorised Dealer as defined below, specified in the sales receipt or an equivalent documents evidencing purchase.

TERM means during the lifetime of the Buyer – a natural person, or during the term of registration of a legal entity. 

WARRANTY means this Warranty given by the Supplier.

SPECIALIST+ means the warrantor.

QBRICK RED means all the products of QBRICK RED product line supplied by RM TOOLS, UAB that are marked with a designated warranty sticker (see Annex 1).

AUTHORISED DEALER  means an authorised representative or trade partner of RM TOOLS, UAB, including retailers and wholesalers, which sell  QBRICK RED products supplied by the Seller.


2. TERMS OF WARRANTY


2.1 Subject and Term of Warranty


SPECIALIST+ gives the Warranty to QBRICK RED storage systems and parts thereof, toolboxes and boxes.


The Warranty applies subject to fulfilment of the following conditions:

2.1.1. A QBRICK RED product was bought from the Seller at the Seller’s trading venue or through the Seller’s sales channel, or from the Authorised Dealer on or after 1 January 2024; and

2.1.2. During the warranty term, the product was used strictly according to its intended purpose and the product’s specifications set forth in the user instructions.


The Warranty is valid for the first Buyer only and will remain in effect throughout the Term.


2.2 LIMITED WARRANTY COVER


Should SPECIALIST+ acknowledge a defect of a QBRICK RED product regarding which a lawful claim has been made under these Terms of Warranty, SPECIALIST+ will offer, at its discretion, one of the following options to the Buyer:

1.  Repairing the QBRICK RED product free of charge; or

2.  Replacing faulty/broken parts free of charge; or

3.  Replacing the QBRICK RED product with the same product or an equivalent product of the same price at which the original product was purchased.


Repairs and replacement under the Warranty will be free of charge for the Buyer. Expenses for delivering the product to the warranty service location will be paid by the Buyer.


The Warranty cover does not include:

1. Specific components except the parts that are part of the original product as a complete set;

2. Parts and materials the wear of which has naturally resulted from operation (parts and assemblies that are subject to normal wear and tear): wheels, bearings, threads, rubber gaskets and other consumables;

3. Non-original QBRICK RED products or accessories, or products/accessories that were bought not from the Authorised Dealer or the Seller, and were bought outside the territory of the Republic of Lithuania;

5. Products that have been modified by the Buyer or third parties;

6. Defects that have resulted from abnormal use;

7. Defects that have resulted from abuse or improper use of QBRICK RED;

8. Defects that have resulted from improper or insufficient maintenance, e. g. defects resulting from corrosions of materials due to aggressive detergents or incompatible products, or repairs/maintenance carried out by third parties and not by the Seller;

9. Defects that have resulted from accidents and other events not related to the defects covered by this Warranty;

10. Defects that have resulted from negligent transportation of QBRICK RED products;

11. Defects that were visible or easily detected at the moment of purchasing the QBRICK RED product;

12. Defects resulting from environmental, climatic or other conditions;

13. Changes in appearance (including colour, surface scratching and similar changes) when there has been no change in the product’s functional characteristics;

14. Product/products or parts thereof that the Buyer has not delivered to a warranty service location and has not transferred it to the Seller.


This Warranty is given to the first Buyer only. SPECIALIST+ is not liable for any damages as its liability under these Terms of Warranty is limited to the remedies explicitly stated therein, unless applicable laws state otherwise. In particular, no indirect, consequential and accidental losses are covered.


In the case of repairs of a QBRICK RED product:

1. No new warranty will apply to the replaced parts or assemblies;

2. The QBRICK RED parts replaced become property of SPECIALIST+.


2.3 Claim Procedures


Procedures set forth below must be followed in making a claim under these Terms of Warranty. The Warranty will apply provided that SPECIALIST+ acknowledges a defect under these Terms of Warranty.

In order to make a claim concerning a defect of a QBRICK RED product, the Buyer has to apply to the Seller by the end of the Term by filling in a form on https://www.rmtools.eu/lt/qbrick, with visual evidence attached. At the Seller’s request, the Buyer has to deliver the QBRICK RED product that the Buyer claims to be defective to a warranty service location, together with:

1. A proof of purchase of QBRICK RED (invoice or a fiscal receipt) specifying the product type and model, date of purchase, and the Buyer’s details; and

2. Description and photographs of the defect.



2.4. Warranty Service Locations

Expenses of the product’s delivery to a warranty service location are paid by the Buyer.


2.5. The Seller will reply to the Buyer’s claim within 14 (fourteen) days after receipt of the claim. Should it be determined that the product is covered by the Warranty, the Seller undertakes to complete repairs or other actions under p. 2.2 above no later than within 60 (sixty) days after receipt of the claim.


Representatives of SPECIALIST+ will verify that the defect exists. Therefore, application of the Warranty under this document is always subject to verification and approval by a SPECIALIST+ representative.


3. APPLICABLE LAW


This Warranty is governed by the Lithuanian law. Any dispute arising from or related to validity, implementation or application of the Warranty will be resolved according to the Lithuanian law.


SPECIALIST+ reserves the right to amend these Terms of Warranty without notice.
